By confirming this order, you authorise Michael Crawford Funerals to arrange the respectful transfer of your loved one into our care, manage all legal documentation, coordinate the cremation, and register the death with the relevant registry.

This service is a straightforward, dignified cremation arranged in accordance with Victorian laws and our professional standards.

Our standard business hours are 9:00am to 5:00pm, Monday to Friday. Transfers that occur after-hours, on weekends or public holidays will incur an additional fee of $495. Viewings are also optional, but also incur additional fees, these will be clearly outlined on the final invoice.

A 24-hour cooling-off period applies from the time of order submission. If the transfer of the deceased has already occurred and you cancel within this period, a $660 transfer fee will be deducted from your refund. Refunds are not available once cremation documentation has been lodged, or cremation has commenced.

Please note that all personal effects provided with the deceased will be cremated, unless we receive clear written instructions to return or remove specific items.

Michael Crawford Funerals – Terms and Conditions for Simple Basic Direct Cremation (No Ceremony/Attendance)

By submitting this order for a Direct Cremation with No Ceremony, you confirm that you have read and agree to the following Terms and Conditions. These terms comply with Victorian laws and the operational policies of Michael Crawford Funerals.

1. Nature of Service

This agreement relates to a Direct Cremation with No Ceremony, which includes:

• • • Transfer of the deceased into our care as soon as possible
    • Completion of all necessary legal documentation
    • Management and coordination of cremation
    • Registration of death with the Victorian Registry of Births, Deaths & Marriages
    • Basic Cremation Coffin & Cremation to take place at a crematorium of our choosing
    • Ashes/cremated remains held at our head office for collection by authorised person/s. Or collection by authorised person/s directly from crematorium (as per client instruction)

This service does not include a funeral ceremony, viewing, formal memorial, or dressing of the body. (unless specified)

2. Business Hours and Surcharges

• • • Standard business hours: 9:00am – 5:00pm, Monday to Friday.
    • Transfers of the deceased occurring after hours, on weekends, or public holidays will incur a surcharge of $495.
    • You will be informed of any additional charges prior to proceeding.

3. Cooling-Off Period and Cancellations

• • • A 24-hour cooling-off period applies from the time of order submission.
    • If the cremation has not commenced, you may cancel within this period by notifying us in writing or by phone.
    • If the transfer of the deceased has already occurred, a $660.00 transfer fee will be deducted from any refund issued.
    • After the cooling-off period, and once legal documentation has been submitted or cremation has commenced, refunds are no longer available.

4. Client Authorisation and Responsibilities

By placing this order, you:

• • • Confirm you are the Authorised Person under the Cemeteries and Crematoria Act 2003 (Vic).
    • Agree to provide all required information about the deceased for legal and registration purposes.
    • Acknowledge that cremation cannot proceed until all statutory documentation has been received and approved online (no personal meeting with consultation is included)

This includes:

• • • Medical Certificate of Cause of Death
    • Coroner’s Certificate (if applicable)
    • Application for cremation (Form 4)
    • Death Registration Form for BDM

5. Personal Effects

• • • If any personal items are to be returned to the family or removed prior to cremation, this must be clearly communicated to us in writing by the Authorised Person prior to the cremation taking place.
    • Unless otherwise confirmed by us in writing, all personal effects provided with the deceased will be cremated.
    • We accept no responsibility for items cremated due to the absence of written instructions.

6. Privacy and Confidentiality

Michael Crawford Funerals is committed to protecting your privacy. Under the Privacy and Data Protection Act 2014 (Vic):

• • • Personal information is used solely to fulfil our duties in relation to funeral and cremation services or where legally required.
    • We do not disclose information to third parties without the family’s consent, except when required by law.
    • All information is treated as strictly confidential by our staff.

In the case of a Private Funeral, no information regarding service times or the deceased will be provided to members of the public.

7. Handling of Ashes

• • • Ashes will be available to collect from our head office (226 Main Street, Bacchus Marsh VIC) during business hours, or stored as instructed in writing by the Authorised Person. Collection of cremated remains directly from the crematorium if preferred, is also an option.
    • If no instruction is provided within 30 days of cremation, we will attempt to contact the Authorised Person.
    • If not resolved within 60 days, ashes may be stored securely or transferred to the custody of a cemetery authority, in accordance with the Cemeteries and Crematoria Act 2003 (Vic).

8. Fees and Payment

• • • A full fee schedule is provided at the time of booking.
    • Payment must be made in full prior to cremation.
    • Surcharges (e.g., after-hours transfers or viewings) will be clearly identified and added to the final invoice.

9. Limitation of Liability

• • • We will take all reasonable care in the provision of our services.
    • We are not liable for delays caused by third parties, regulatory authorities, or circumstances beyond our control.
    • Our liability is limited to the resupply of services or refund, in accordance with the Australian Consumer Law.

10. Governing Law

These Terms and Conditions are governed by the laws of Victoria, including but not limited to:
